Terms of Service

1. Acceptance

By creating an account or using the ATMO Agent Partner Portal (the "Portal") provided by ATMO School Ltd ("ATMO", "we") you agree to these Terms of Service ("Terms"). If you are signing up on behalf of a Partner Agency, you confirm you have authority to bind that agency. These Terms apply alongside the signed Partner Agreement governing the commercial relationship between ATMO and the Partner.

2. The service

The Portal lets Partner Agency staff submit prospective student applications to ATMO, track them, communicate with the ATMO admissions team, download marketing materials, and (for Account Owners) view commissions and payouts. ATMO may change, suspend, or discontinue any Portal feature at any time, with reasonable notice where possible.

3. Account registration

You agree to (a) provide accurate registration information, (b) keep your password and authenticator credentials confidential, (c) immediately notify ATMO if you suspect unauthorised access. You are responsible for activity under your account.

4. Acceptable use

You may not:

• submit false, misleading, or fraudulent Applicant data;
• upload malware, copyright-infringing content, or content unlawful in the recipient's jurisdiction;
• attempt to reverse-engineer, scrape at scale, or circumvent rate limits, captchas, or security measures;
• impersonate other users or ATMO staff;
• use the Portal in violation of applicable export, sanctions, anti-bribery, or consumer-protection laws.

5. Intellectual property

ATMO retains all rights in the Portal software, ATMO brand, programme content, and marketing materials. You receive a limited, revocable, non-exclusive licence to use them to promote ATMO programmes to prospective Applicants for the duration of the Partner Agreement.

6. Data submitted by you

You confirm that you have all necessary consents, including, where the Applicant is a minor, parental or guardian consent, to share Applicant personal data with ATMO. ATMO handles Applicant data per the Privacy Policy.

7. Availability and changes

We aim for high availability but do not warrant uninterrupted service. We may carry out maintenance and update the Portal, including breaking changes, with notice in the dashboard where practicable.

8. Disclaimer

The Portal is provided "as is" and "as available". Except as required by law, ATMO disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement. ATMO does not warrant any particular admissions outcome for any specific Applicant.

9. Limitation of liability

Nothing limits ATMO's liability for (a) death or personal injury caused by negligence, (b) fraud or fraudulent misrepresentation, (c) any liability that cannot be limited by law. Subject to that, ATMO's total aggregate liability arising from your use of the Portal in any 12-month period is capped per the signed Partner Agreement (or, if no Partner Agreement applies, £25,000). ATMO is not liable for indirect or consequential losses.

10. Termination

You may stop using the Portal at any time. ATMO may suspend or terminate your access for material breach of these Terms or the Partner Agreement, or where required by law, regulator, or to protect the Portal and other users. On termination, commercial obligations including commission clawback windows continue per the Partner Agreement.

11. Governing law and disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that ATMO may bring proceedings to enforce its intellectual property rights in any competent court.

12. Changes to these Terms

We may update these Terms; the updated version takes effect 14 days after publication on this page. Material changes will be highlighted in the Portal or by email.
